✧ — terms of service

These terms are subject to change how I see fit without notice. Breaking these terms will result in a blacklist from all future commissions and adoptables.

All terms related to artwork also apply to designs.

✧ Payment & Ordering

✧ A minimum of 50% of the payment is required upfront unless alternatives are discussed beforehand. I will only deliver completed commissions once the cost is paid in full.✧ Payment plans may be worked out for larger commissions.✧ Clear digital references are preferred. I cannot assure a completely accurate representation of your character or chosen subject if proper references are not provided.✧ I reserve the right to add on complexity fees to any artwork.✧ I reserve the right to deny your commission for any reason, particularly if it promotes hate or bigotry.

✧ Artwork Edits

✧ I reserve the right to add additional fees for edits and changes.✧ Any overhauls to the artwork must be requested prior to the completion of the artwork. Small changes may be requests after the delivery of the final piece, but may not be possible to implement.✧ My ability to edit the artwork is at my discretion. I can refuse to make an edit or change for any reason.✧ You may edit the completed artwork as you see fit, as long as I am still credited as the creator of the artwork and I receive notice and consent to any changes made.

✧ Artwork Timeline & Usage

✧ I am not obligated to follow through with artwork unless I receive proper payment. Trades are considered a form of payment.✧ Works created solely by me will be completed by the end of the month they are ordered within unless I give prior notice. I will only grant refunds once this deadline has passed.✧ Paid work will receive priority over unpaid work.✧ I reserve the right to add additional fees for moving a commission ahead in the queue.✧ I reserve the right to add additional fees for moving a commission ahead in the queue.✧ I will provide a preview of the artwork upon the completion of the sketch. Additional previews may be requested.

✧ Artwork Ownership

✧ Only myself, the commissioner, or the current owner of the artwork have permission to use commissioned work, including anyone given express permission by me, the commissioner, or the owner.✧ The commissioner can transfer artwork ownership at their discretion, such as in a transfer of character ownership. Notifying me of transfers is not required. However, notifications are still appreciated.✧ My artwork is not to be used for NFTs or as prompts for AI generators under any circumstances. Do not input my work into AI for any reason.✧ I may post commissioned art anywhere I see fit unless another arrangement has been made with the commissioner beforehand.✧ When posting artwork made by me on social media, e.g. Discord, DeviantArt, or Instagram, credit me as the artist.

✧ Refunds

✧ Refunds will only be given if the artwork is incomplete.✧ Full refunds will be given if I have not started on the artwork. Otherwise, I will only repay half of the original price of the commission for a finished sketch, and a quarter if I have started lineart.✧ It is necessary to contact me to request a refund. A refund may not be given in every situation.

✧ Design Rights

✧ You are only the owner of the final design. I have the right to keep or reuse any previous drafts I make unless I receive additional compensation.✧ Edits to the final design will be provided free of charge within a reasonable margin. I withhold the right to ask for additional payment for redesigns.✧ You have the right to alter any of my designs you own as you see fit, as long as no hateful content is included.✧ Credit must be given to me when uploading the design or character to a storage website, e.g. ToyHouse, CharacterHub, even if the design has been modified in some way.✧ Do not claim the design as yours or as another person's unless you or another person altered the design. In that case, you may credit multiple people, including myself, for the design.

✧ Design & Character Transfers

✧ I must receive notice of any transfer of ownership of a design, including co-ownership, alongside which person(s) are receiving it.✧ New owner(s) of the design must be notified of any designer(s) when transferred.✧ Do not sell designs for more than their original worth unless they come with additional art or other creative pieces. Likewise, free or traded designs are not to be sold for any currency unless they come with additional art.✧ Transfers, including trades and gifts, are allowed at any time.

✧ Original Artwork

✧ I am the owner of any artwork made for the design. If I used a base, I am instead the co-owner. You cannot make alterations to the original art without prior notice and consent.✧ Give credit to any base makers. I will provide you with a link if necessary.

✧ Refunds

✧ Full refunds will be given if I have not started on the design. Otherwise, I will only repay half of the original price of the commission.

✧ Commissions are worked out via my Discord (@ashenoia). I will send updates for edits & approval at both the sketch and colour phases.✧ All prices are in $USD. Payment is only accepted through PayPal, Ko-Fi, or Discord Nitro.✧ For multiple characters in a single piece, each extra character costs the same as the original.✧ If a design would take a large amount of time to replicate, I will charge a complexity fee at my discretion. Accessories are considered for complexity fees.✧ Human(oid)s are charged at higher rates due to longer drawing times.

✧¹ Simpler RP banners utilise pre-drawn art. Please gain permission from the original artist prior to commissioning me if applicable.✧² Reference sheet prices are equal to the price of any art drawn for it. I may add small fees for additions such as paw views, accessories, or other drawn aspects of the reference.✧ Artwork with variable prices will be worked out on the basis of each piece. Prices may be higher than the given minimum.
